What is the difference between the expungement of my records and the sealing of my records?

If your ultimate goal is to remove your criminal record from the public’s view, there is not much difference between the expungement of your records and the sealing of your records. Sealing, however, does not require certain agencies to complete destroy your records, whereas a court-ruled expungement does. The qualifications for expunging and sealing records are also very different and break into two situations:

  • If the charges against you were dismissed or dropped, you are qualified to have your criminal history expunged.
  • If you pled guilty or no contest to the charges brought against you and had adjudication of guilt withheld, you are qualified to have your record sealed.
